First the Wedding, Then Years in Prison

WHEELING — A bittersweet story of love and the law developed Thursday when Cupid made a St. Valentine’s Day visit to an Ohio County courtroom.

Circuit Judge James Mazzone officiated at the wedding of Misty Johnson and Kevin Felder just moments after Mazzone sentenced Felder to five to 18 years in prison for robbery.

Asked to comment on the unfortunate circumstances surround the marriage, Felder said, “It is a decision between the two of us. I am sorry for what I did, and I want to be a better man when I come home.”

After saying goodbye to her new husband as he was escorted from the courtroom, the bride tearfully offered her assessment of the situation.

“I love him that much,” she said. “That’s all I can say.”

Felder, dressed in an orange jail jumpsuit rather than a tuxedo, asked Mazzone if he could have his handcuffs removed during the wedding ceremony. The judge declined.

“I’m sorry, but I can’t allow that,” Mazzone said. “You are in custody.”

Felder was escorted out of the courtroom moments after the couple exchanged wedding vows.

During the criminal hearing, Felder pleaded guilty to one count of second-degree robbery. Assistant Ohio County Prosecutor Steven Vogrin said Felder robbed the Wheeling Island Convenient store on Sept. 5.

“He placed the fear of bodily harm into the clerk,” Vogrin said. “He reached his hand in the cash register and when she touched his hand, Mr. Felder told her to, ’Let go or I will kill you.’”

Vogrin said Felder fled the store with $340 in cash.

During the sentencing phase of the hearing, Vogrin said Felder committed the robbery while he was on probation for a July 20 domestic violence offense involving Johnson, his then-girlfriend. Vogrin said as part of the plea agreement, the state would not seek recidivist status against Felder, who has two previous felony convictions and could have been facing life in prison.

Prior to sentencing, Felder told the court, “I am sorry for the things I did. I know I have to pay a cost.”

Defense attorney Martin Sheehan told Mazzone he believed Felder was truly remorseful for his actions.

“This was not something he had planned,” Sheehan said. “It was an impulsive act.”

Another defense attorney, Frank Lash, ask Mazzone to recommend Felder be sentenced to a penal facility as close as possible to Pittsburgh, Pa., to accommodate family members who want to visit him. Mazzone said he has no control over where prisoners serve time, but added he would make a recommendation as part of the record.

But Thursday’s nuptials did not mark the first time a wedding followed a sentencing in Ohio County.

On Sept. 5, 2003, Circuit Judge Arthur Recht performed a similar marriage ceremony after sentencing David Appleby to life in prison. The Appleby sentence became a matter of West Virginia case law reference after the West Virginia Supreme Court of Appeals upheld Recht’s decision that third-offense driving under the influence of alcohol is a violent crime.

If they loved each other, and he was truly sorry, then they could have made steps to stop his drug use and have gotten married PRIOR to being arrested. I'm sorry, but this article did not deserve to be put in the Valentine's Day issue!! Talk about rewarding bad behavior!!!

This was far, far less a story about "love and the law" than it was about an the misplaced responsibilities of a woman who even now is failing to protect her own, unborn child, and the abuser who claims to "love" her so much that he abused her, did drugs, and robbed a store, when we all know he could have done something to get straight.

It is about not about "love and the law": it is about selfishness, and utter, utter lack of responsibility on the part of every single person there, with the exception of the unborn child. That judge who is trying to get this violent man closer to his family should be there in the courtroom in the future, when he's there again for child abuse!

Amelia: I think the judge wishes to demondtate a very neutral position and carry out his duty -as a judge - without personal bias.This is a quality we hope for in judges.Citizens should be viewed equally in the eyes of the law which allows this couple to be married if they wish.The judge executed the letter and spirit of the law as is his duty.

This is a real tear jerker for sure. She LOVES the armed robber. Now she gets Welfare and he will get most of it for his commissary in prison. The rest of us will pay for it. Touching indeed.

I wonder if she has any children by him that he won't be supporting? Women who do things like this give the word idiot a whole new meaning.

atoddh...a testimony to his humanity? He just joined a couple in marriage knowing that they could not legally meet the standards needed to be married. He just signed them both up for years of benefits that will include three squares and a roof for the husband and most likely welfare for the wife. And if she is working, she will get to enjoy tax benefits, health care rights and far more than unmarried couples can enjoy. Meanwhile, truly committed homosexual couples are insulted and people act like they destroy the traditions of marriage. Humanity my butt.

Why is this type of garbage being publicized?!? Sick, sick, sick! And shame on you Judge Mazzone! This is why Wheeling needs a complete overhaul in their officials department! It's time to get some new, intelligent people in to run our city.

This is a crock, Mazzone should have never joined two people in marriage with a recent domestic issue involving the two of them as a couple. She says she just loves him that much. I got news for ya sister, love don't hurt!

This is just another way for this guy to rip off the system. I agree, this should NOT have been publicized. People complain about gay people getting married, but this is a bigger travesty. At least when gay people get married, they are committing to a life to be spent together.
