Stand Up For True Free Choice
By the News-RegisterA threat to democracy at a very basic level - in the workplace - has resurfaced in Congress. It is the Employee Free Choice Act, an inappropriately named bill if ever there was one.
Last year the measure was blocked by lawmakers concerned about true freedom of choice for working men and women. But the proposal has been introduced again in Congress.
Should the bill become law, it would make changes in the rules involving labor unions and employers.
Regulations now provide for a two-tier process by which workers decide whether they want a union. If 30 percent or more of workers at a particular site sign union authorization cards, formal balloting takes place. Then, if a majority of workers vote in favor of a union, it is certified as their bargaining agent.
Taking advantage of the true free choice in the secret ballot process, many Americans reject unions. Some estimates are that as few as 7.5 percent of U.S. workers belong to them.
If the Employee Free Choice Act becomes law, that would change. There would be no guarantee of secret ballot elections before a union took over. Instead, unions could be certified if a majority of a company's workers signed authorization cards - presented to them in public, quite possibly in front of groups of pro-union co-workers. Obviously, intimidation would be a factor.
Another stipulation in the bill is that if a new union could not agree to a contract with a company within 90 days, the matter could be referred to a federal mediator. If no agreement could be reached 30 days after that, the dispute would be referred to arbitration. Results of the arbitrator's decision would be binding on the union and the company for two years - even if union members disagree with them.
Former Sen. George McGovern, the Democratic Party's nominee for president in 1972, has been a good friend of labor unions. He has broken with them on this issue. In an opinion piece in the Wall Street Journal, McGovern stated that the Employee Free Choice Act "runs counter to ideals that were once at the core of the labor movement. Instead of providing a voice for the unheard, EFCA risks silencing those who would speak."
Concerning approval of unions solely through authorization cards, McGovern noted, "There are many documented cases where workers have been pressured, harassed, tricked and intimidated into signing cards ..." He added, "Under EFCA, workers could lose the freedom to express their will in private, the right to make a decision without anyone peering over their shoulder, free from fear of reprisal."
McGovern has a persuasive answer to members of Congress who insist that they have to support organized labor leaders who backed them. In his opinion article last summer, McGovern put it this way: "While it is never pleasant to stand against one's party or one's friends, there are times when such actions are necessary I hope some of my friends in Congress will re-evaluate their support for this legislation. Because as Americans, we should strive to ensure that all of us enjoy the freedom of expression and freedom from fear that is our ideal and our right."
The distinguished public servant is right. Members of Congress who truly want free choice for workers should vote against the dishonestly titled Employee Free Choice Act. They should stand with McGovern - for what is right.

popeye- i work with union and non union workers. i truly find that each individual is that, some good and some bad on both sides of the aisle. i have never been in a union myself, but i do work with union folks and feel that they do have valid points while protecting their jobs. if you are really in the transportation industry you would be aware of large gov subsidized carriers that put smaller carriers at risk. they are non union, hire drivers for less, and get subsidized for hiring and fuel. how does that add up? other than policies of the previous administration to break unions. again, i am not a union worker. just able to see both sides.

Thoughtful The leadership cares NOTHING about the rank and file. They only care about holding on to power. They use dues money to buy political influence. They use dues money to fly on private jets. They use millions in dues money to buy mansions that are called "union training centers" and millions more to buy country clubs labeled "union coference & retreat centers". The unions were required, some years back, to disclose their political involvement and to permit membership to withhold that portion of their dues that went to political activities. The unions have yet to fully comply with this. If unions are so wonderful, why don't you people ask yourself this: why is the UAW 75% smaller than it was 20 years ago? Why is the USWA signing up janitors? The union does NOTHING to save your job. All of you people at Severstal will lose your jobs, partially because of the idiots running your union.

The leadership of the Democratic Party would love the day that not one ounce of coal was burned in this country. See the comments of Al Gore, Harry REid, Nancy Pelosi, and the entire Democratic congressioonal delegation from the West Coast. Yet, the UMW of America marched in support of the candidates. This is absolutely beyond my comprehension. Long live unions but don't ever think of using coal again. You figure that one out. Possibly, the union leadership and cares little for the rank and file.

Let's be clear.This must be an important issue for Unions as thye spent over $100Million Dollars electing Obama. WE must face that fact that our country has changed. Nolonger are we faced with challeniging working conditions, child labor, totally unsafe working conditions. We need to hold wrokers accountable, reward those that produce with superior pay, and single out extra contributors with extra recognition. The second part of the legislation is the most troubling which mandates mandatory artbitration which leaves the business owner completely without any power whatsoever. We need jobs, build our economic infrastructure, and lower unemployment for all Americans. We need to create jobs here in this country. This bill will not support that effort. Let's face it, this is a payoff to the Union leadership who care little for the rank and file. During the recent election, I took the time to fully read the United Mine Workers web site and support of Obama.Unbelievable. beyond belie

I do find it interesting the Democratic supporter/Obama advisor Warren Buffet said the following "I think the secret ballot's pretty important in the country. I'm against card check to make a perfectly flat statement," He called the EFCA a "mistake" in the same interview.

Let me give you an example: when the steel market hit record heights in 2008, the USWA negotiated hefty contracts with US Steel and Mittal. Now the the market is in a historical slump. The USWA is in negotations with Severstal, whose local workers are at the greatest risk of losing all. Does the USWA soften its' stance, admit reality, offer to help out? NO! Instead, their leadership announced that they will demand the same generous contract terms negotiated at US Steel and Mittal at the peak of the market. Say it with me, slowly: HEAD IN THE SAND. The USWA is putting Severstal in a position where they will have no choice but to eliminate all the steel jobs in the valley. And Severstal has a leg to stand on. After all, they can point to the USWA's unrealistic stance on contract negotiations.

destroy - While it is unlikely that "hard proof" of what was done with this person's job or position as a result of union manipulation, the very fact that the individual's participation on the Obama phone bank project was "monitored with a sign-in sheet" stinks to high heaven. That is unacceptable and wrong. You should be able to see that?

The Unitrd Food and Commercial Workers Union has a large percentage of its membership that make minimum wage with no benefits. They should be recieve a refund of thier union dues or look to a labor lawyer to sue the union. Wake up District 23

Here is a little example of what unions do. I have a student who takes continuing education classes on weekends, during which I teach. She was a server administrator for a large Pittsburgh steel company. The union in that company took part in an Obama phone drive that they recommended members to take part in, and monitored attendance by a sign in sheet. Simply, my student did not take part, and two days later was made a secretary. Likely, though, they could not lessen her pay due to union rules. Truly disgusting behavior. They also eliminated that position to cover their tracks and created another position with a different name. Go unions! Freedom of choice my arse!
